However all the support in the world from UT,BMS and the FF team have since the release of BMS2 not solved either the radar issue nor the lack of SSE support for FF3. End Quote:
The Radar issue, and SSE issues persisted due to the same people who released the current EXE. I fixed the radar bug some time before the FreeFalcon exe was released. However FreeFalcon, in thier infinite stupidity, decided to release an exe based partially on old code. There were numerous other features missing because FreeFalcon could not wait. You did not get a SSE exe because FreeFalcon did not have a compiler capable of it. And do not believe where they say that the previous "FreeFalcon.exe" was compiled before the cut off date, it was not, it is a complete lie.
So, in the case that you are totally dense: This is now TWICE that FreeFalcon has tried to undermine BMS, this is the SECOND time they have released an incomplete EXE. This is the SECOND time that they have taken the BMS coder's work, work that was for both groups, and made it EXCLUSIVELY for themselves.
However, there were some differences this time around.
This time Saint was "kind" enough to warn us of the impending release several minutes before hand.
And Baldeagle was nice enough to play "BMS member" while spying on us for FreeFalcon. It's funny how FF members 'know' what goes on in the BMS irc channel when they are never there, ie Saint accusation of BMS making a release for the SP group. (and to dispell that, BMS wasn't making a SP specific exe, SP management got the same Exe that Fred & Saint, and therefore FF had access to). Nevermindfixing the bugs he introduced in to BMS, while he watched several other members try to fix them. Atleast he fixed them for FreeFalcon's new exe.
You people should have learned by now. Are you people blind to the wake of destruction FF has left? The disbandment of ViperOps, basing their initial release off of SP3 and calling it their own, the destruction of the UT, and now they are after BMS.

That IMO (and my opinion alone) tends to lead ME to accept it as the closest thing to the 'truth' regarding the history of F4 dev lately. Jam's thread (official statement) only confirms it for me.

F4 was a decent product for its' time. Without the work of everyone, it would've been relegated to the bargain bin years ago. I personally don't see the work by anyone who has modified the .exe as theft, just as improvement.
I know, many will respond with scathing criticism of what I just said as something akin to child pornography. But, it is not wrong. How many mods have been made to Doom, or Quake, or HL, or MSFS, etc.? Many were NOt made with consent to use the source code, but because they weren't for profit, Valve, MS, and id all embraced the mod community.
Great Points Hammer. Especially the fact that this was not released for profit. If anything, this along with the other mods, will generate sales for Atari if they ever decide to re-release the game.
As you pointed out, this is just another Mod. Which, IMHO, dismisses all those arguments about the legallity of the Mod itself. Yeah it would be nice to also have an SP4 compatible Mod, but who knows maybe that's in the works.
Obviously, there may be more than we know (as far as the theft of the code for this mod). If that is what happened. I do not believe anyone here condones the theft of anything, so no argument here. However, there seems to be so much cloak and dagger mystery surrounding the facts, that we may never know all of the facts.

Very short sum up:
BMS works as one group to continue Falcon Saga with great improvements that benefits both SP and FF fanatics. Since the C&D the group has continued developing in hope for a possibel release.
Two guys within this team (Saint and Baldeagle) takes the work and releases some of it under a groupname CobraTeam.
This is done after some month were Saint has not been active on BMS Irc channel and not contributed with developments to the group. In this period Baldeagle is lurking in the channel and is not very helpfull during the work of fixing AI taxi bug.
The released exe is not for the community but soly for the FF group becourse there is build in CTD when the exe is run on SPx installation.
This is not BMS way of supporting community and as such a to those that fancy's SPx.
BMS is upset and very disappointed mostly becourse all the developers was not asked for permission. Saint just enter BMS channel and tell what he and Baldeagle will do. Dispite BMS asking them not to the answer is "it's to late" and minutes after the exe can be downloaded from FF website.
This tells us that they had planed to do this for a longer period.
They dont respect the teams members work and just take what has been made by others hands.
On top of this it might prevent chance of making a "legal release".
The choice of name "CobraTeam" is also chosen to give the impression that it comes from Cobracab and as such should legalize it. Let me point out that Cobracab has nothing to do with this, im sure it cant be said enough times.
Next step is waiting to hear what Saint and Baldeagle has to say.
Hope this sum up helps getting the overview.
